The child’s appeal was dismissed and she
was not permitted to claim compensation in respect of her diagnosis of foetal
alcohol spectrum disorder which was a direct result of the mother’s excessive
drinking during pregnancy.

The child was born with foetal alcohol
spectrum disorder as a consequence of the mother’s excessive drinking during
pregnancy. An application for compensation was made to the Criminal Injuries
